1. As per the record, we find that a one time settlement was approved on 22.05.2024 on an application dated 22.05.2024 of the petitioner. Alongwith the application the petitioner had also deposited Rs. 60,000/-. Still further we find that as per the one time settlement which was approved on 22.05.2024 the petitioner had to deposit the entire remaining amount within a period of 90 days from 22.05.2024.
2. Sri Mohammad Ishan, Advocate holding brief of Ms. Alfiya Bano, learned counsel appearing for the Bank, however, submits that if the petitioner deposits the entire amount, which was to be deposited in the 90 days period, within a period of one month then the Bank shall accept the same.
3. However, we consider it appropriate and in the fitness of things that if the petitioner deposits the remaining amount within a period of two months then it shall be accepted by the Bank without considering the fact that the petitioner had dishonored the one time settlement.
4. We clarify that, if, the amount as has now been promised by the petitioner to be deposited is not deposited as per the undertaking, then the Bank shall be free to recover the debt in accordance with law.
