The petitioner claims that she is entitled to arrears of family pension. He has made a representation in this regard but to no avail. Learned Standing Counsel for the respondents No.1 to 5- State submits that the issue requires determination of facts by the competent authority as per law in the first instance. However, he contends that her claim regarding grant of arrears of family pension are liable to be decided by the competent authority in a reasonable time frame. In light of the aforesaid submissions and without going into the merits of the case, the respondent No.6-Executive Officer, Nagar Panchayat-Bithur, District-Kanpur Nagar shall decide the representation of the petitioner regarding payment of arrears of family pension as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally disposed of.
