THE HON’BLE SRI JUSTICE HARINATH.N CRIMINAL PETITION No.2812 OF 2025 ORDER: 1. Heard the learned counsel for the petitioner. 2. The learned counsel for the petitioner submits that the petitioner was arraigned as A.1 in Crime No.53 of 2023 of Atchampet Police Station, Palnadu District, registered for the alleged offence under Section 324 read with Section 34 of the Indian Penal Code, 1860. 3. It is alleged in the complaint that the petitioner, along with others, quarreled with the de facto complainant and others and beat them. The learned counsel submits that the petitioner has no acquaintance with the 2nd respondent/ de facto complainant, and he was falsely implicated in this case. The learned counsel further submits that the offences alleged against the petitioner are punishable below 7 years and, therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 4. Considering the submissions of the learned counsel for the petitioner, the Investigating Officer/ Station House Officer, Atchampet Police Station, Palnadu District, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, for the purpose of investigation in connection with Crime No.53 of 2023, insofar as the petitioner is concerned. 5.
