Bipin, learned counsel, appeared for the petitioner; and Mr. Kh. Samarjit, learned DSGI, appeared for the respondent. The present writ petition has been filed assailing the uncommunicated ACR/APAR of the petitioner and also the communicated ACR/APAR of the petitioner which has been downgraded by the authorities and the further prayer made by the petitioner is that upon quashing of the said uncommunicated ACR/APAR of the petitioner, his case be considered for promotion for the purpose of availing pensionary benefits. Mr. Kh. Samarjit, learned DSGI appearing for the respondents, submitted that during the pendency of this writ petition, the petitioner has already been promoted to the next higher post and thereafter he has taken voluntary retirement. The learned DSGI submitted that due to subsequent events which occurred after filing of the writ petition, no cause survives for adjudication and the present writ petition can be closed as infructuous. Recording the submission made by the learned DSGI, the present writ petition is hereby closed as infructuous.
