Heard learned counsel for the petitioners, learned A.G.A. for the State-respondents and perused the material brought on the record. 2. At the very outset, learned A.G.A. for the State-respondents pointed that that in the instant matter investigation has already been concluded and charge-sheet has also been submitted against the petitioners and pursuant to the filing of the charge-sheet, learned Magistrate concerned took cognizance of the offence and summoned the petitioners to face the trial vide order dated 25.7.2025. Learned A.G.A. by placing reliance upon the judgment rendered by the Hon'ble the Apex Court in Special Leave to Appeal (Criminal) No. 13578 of 2024 (Neeta Singh and Others Vs. State of Uttar Pradesh & Others) has further submitted that the present writ petition has become infructuous and appropriate remedy lies by exercising the inherent powers of this Court under Section 528 B.N.S.S.. 3. Learned counsel for the petitioners could not dispute the aforesaid facts and submits that he does not want to press the instant petition and the same may be dismissed as withdrawn Versus Counsel for Petitioner(s) : Devid Kumar Singh, Prateek Rai Counsel for Respondent(s) : G.A.
