Heard Shri Pushkar Kushwaha, learned counsel for the petitioner and Shri Adarsh Bhushan, learned counsel for the respondent no. 2 and 3. Shri Pushkar Kushwaha, learned counsel for the petitioner submits that the petitioner is entitled to revised pay scale and other consequential service benefits. He has made a representation in this regard but to no avail. The only prayer made by the petitioner is that the claim for revised pay scale including other entitlements be decided within a stipulated period of time. Shri Adarsh Bhushan, learned counsel for the respondent no. 2 and 3 contends that the matter requires factual determination as per applicable law by the competent authority in the first instance. However, he fairly contends that the service benefits/claims are liable to be decided by the competent authority in a reasonable time frame. In the wake of preceding discussion and without going into the merits of the case, the respondent No.4- Executive Engineer, Electricity Distribution Division, Purvanchal Vidut Vitran Nigam, Chandauli, shall decide the claim of the petitioner for revised pay scale and other consequential service benefits as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation.
