Judgment 24/03/2025
Learned counsel for the petitioner appearing via Video Conferencing has submitted that an amended writ petition is filed. It is further submitted that in spite of the fact that the petitioner is higher in merit, the petitioner is not given due options which were available during the course of second round of counseling.
Learned counsel for the respondent has made the following preliminary and auxiliary objections:-
1. That the present petition is not tenable as the petitioner has challenged the rules of the game after duly participating in the examination.
[2025:RJ-JP:13135] (2 of 2) [CW-3703/2025]
2. That as per NMC and MCC guidelines once in the second round of counseling appointments/options are exercised by the candidate by way of online procedures, no further participation in the next round or further round is permitted.
3. That as on date entire selection process/rounds are over therefore, the prayer made by the petitioner cannot be honored and is merely of academic importance. Considering the foregoing facts and circumstances of the case; taking note of the fact that the petitioner has duly participated in the impugned selection process and has subsequently challenged its rules, this Court while keeping the point of law open for consideration, deems it apposite to dispose the present petition as it is of academic importance as on date. Accordingly, the present petition is disposed of. Pending application(s), if any, shall stand disposed of.
