The petitioner has moved this Court for grant of bail in connection with Kathikund P.S. Case No.35 of 2024 registered for the offences punishable under sections 309(6) of the B.N.S., 2023.
The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner committed robbery and looted the motorcycle and other valuables of the informant. It is further submitted that the allegations against the petitioner are all false and the petitioner is not named in the FIR. It is next submitted that the petitioner has no criminal antecedent as has been mentioned in paragraph no.14 of the bail application. It is then submitted that the petitioner has been in custody since 11.09.2024 as has been mentioned in paragraph no. 15 of the bail application and charge sheet has been submitted. It is also submitted that without putting the petitioner in T.I. Parade, charge sheet has been submitted against the petitioner. It is next submitted that the petitioner undertakes to cooperate with the trial of the case. It is lastly submitted that the co-accused person has already been admitted to bail by a coordinate Bench of this Court vide order dated 27.02.2025 in B.A. No.1655 of 2025. Hence, it is submitted that the petitioner be also admitted to bail.
The learned Addl. P.P. opposes the prayer for bail.
Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the abovenamed petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Dumka, in connection with Kathikund P.S. Case No.35 of 2024 with the condition that the petitioner will cooperate with the trial of the case and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the trial of the case.
