Impugned in this appeal filed by the appellant Rayees Ahmad Bandroo, in terms of Section 21 of the National Investigation Agency Act, 2008, is an order dated 29th January, 2025 passed by the Court of Special Judge (UAPA) Anantnag in file No. 573/2024 titled “Rayees Ahmad Bandroo vs UT of Jammu and Kashmir”, whereby the application filed by the appellant for bail in CNR No. JKAN010005832024, Case No. 193/2024 has been rejected. 2. It is submitted by the learned counsel appearing for the respondents that at the time this appeal was filed, only 9 out of 36 witnesses had been examined and that during the pendency of this appeal, eight more witnesses have been examined. 3. Faced with the aforesaid factual position, learned counsel appearing for the appellant would fairly submit that in view of the statement of more witnesses having been recorded by the Trial Court, he would prefer to file a fresh bail application before the Trial Court. 4. He, therefore, prays for leave of this Court to withdraw this appeal with liberty to file a fresh application before the Trial Court. 5. The statement of the learned counsel for the applicant is taken on record. 6. The appeal is dismissed as withdrawn with liberty as prayed for. 7. Needless to say that in case a fresh bail application is filed by the appellant before the Trial Court, same shall be considered and disposed of as expeditiously as possible. 8.
