PUBLIC PROSECUTOR The Court made the following: ORDER: This Criminal Petition, u/Sec.480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, seeking bail, in Crime No.556/2024 of Nunna Police Station, Vijayawada City. 2. A case has been registered against the petitioner and another for the offence punishable u/Sec.376(2)(n), 366(A) r/w 109 IPC and Section 6 of POCSO Act. 3. Heard learned counsel for the petitioner/A1 and the learned Assistant Public Prosecutor representing the respondent/State. 2 4. Case of the prosecution, in brief, is that, the petitioner/A1 along with A2 attended to the painting work at the house of the victim in the month of June 2023 and since then A2 had intimacy with the victim. On 22.4.2024, when the victim was standing near her house, A2 alleged to have come there by a Car bearing registration no.AP 39 A 2267 and took the victim near Shanthi Park road and committed penetrative sexual assault on her. On A2’ call, the petitioner/A1 came there and he committed penetrative sexual assault on the victim three times. Later the victim became pregnant and at that time the victim narrated the story to her mother. Basing on the complaint, police registered a case in the above said crime and arrested A1 01.10.2024. 5. Heard. Perused the record. 6. Learned Assistant Public Prosecutor submits that investigation is at crucial and police are awaiting for DNA report and prays to dismiss the criminal petition. 7. Learned counsel for the petitioner submits that the petitioner has been in judicial custody from 01.10.2024 i.e. for more than 175 days and considering the nature of the allegations, prays to allow the criminal petition. 8. After careful observation of the material on record and submissions made on behalf of both sides, it can be seen that the age of the victim girl is 16 years and she is a minor and this Court is not inclined to grant bail to the petitioner at this stage as the investigation is at crucial stage and police are 3 awaiting DNA report. If the petitioner is released on bail, he may tamper the evidence and hamper the investigation. 9.
