2. Mr. Ayush Agrawal, learned counsel holding brief of Mr. Akhil Kumar Sah,
learned counsel for the respondent.
3. This appeal against dismissal of his divorce petition is filed by the husband.
4. Coordinate Bench of this Court
directed the parties to appear before the counselor attached to the ADR Centre, Nainital, vide
order dated
01.08.2024.
5. Learned counsel for the parties submits that during counseling, parties decided to live together and respondent has joined the company of appellant, along with their child, at Delhi.
6. Learned counsel for the appellant submits that since the parties to the dispute have decided to live together as husband and wife and both of them are living happily together, therefore, appellant wants to withdraw this appeal, as cause of action for seeking divorce do not survive any longer.
7. Learned counsel for the respondent submits that he has no objection if the appeal is dismissed as withdrawn. He
2025:UHC:1221-DB however submits that appellant at time, becomes violent towards his wife and children.
8. In view of the prayer made by
learned counsel for appellant, the appeal is dismissed as not pressed. However, we make it clear that appellant shall not commit any act, towards respondent and their minor child, which constitutes as offence in law.
