Serial No. 44 Regular Cause List HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR CCP(S) 426/2022 in[WP(C) 712/2022] ABDUL MAJEED SHEIKH ……...Petitioner(s) Through: Mr. Sajid Bhat, Adv. vice Mr. Wani Parvaiz, Adv. Versus TARIQ HUSSAIN MIR AND ORS. (CUSTODIAN EVACUEE PROPERTY) .……Respondent(s) Through: Mr. Bikramdeep Singh, Dy. AG CORAM: HON’BLE MR. JUSTICE WASIM SADIQ NARGAL, JUDGE ORDER 18.11.2025 1. The instant contempt petition arises out of an order/judgment passed by this court dated 07.05.2022, by virtue of which the writ petition preferred by the petitioner was disposed of with liberty to approach the Custodian Evacuee Property, Department Kashmir, as well as the Deputy Custodian, North Kashmir, Baramulla for redressal of his grievances. 2. While parting with the aforesaid order, the court had observed that it is for Custodian Evacuee Property, Department Kashmir & the Deputy Custodian, North Kashmir, Baramulla to ensure that the orders passed by them are duly complied with by their subordinates, including the Assistant Custodian, Tehsil Karnah. However, how and under what circumstances contempt is made out is not forthcoming from the averments in the instant contempt petition. 3. Be that as it may, Mr. Bikramdeep Singh, learned Dy. AG, has waived notice on behalf of the respondents, submits that the order passed by the learned writ court shall be complied with in its letter and spirit. 4. In the light of the statement made by learned counsel appearing on behalf of the respondents, no fruitful purpose would be served to keep this contempt petition alive as the direction pertains only to ensuring compliance of the orders passed by the Custodian Evacuee Property Department and the Deputy Custodian North Kashmir, Baramulla by their sub-ordinates. 5. In the light of the assurance so extended, the proceedings in the instant contempt petition are closed. Rule, if any, shall stand dis-charged. 6. Contempt petition is accordingly disposed of.
