The present application under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the applicant to quash the order dated 9.9.2024 passed by Additional Principal Judge, Family Court No. 2, Aligarh in Maintenance Case No. 460 of 2022, arising out of an application under Section 125, Cr.P.C., whereby Family Court directed the applicant to pay Rs. 6,000/- per month as interim maintenance to Private-Opposite Party No. 2. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file appropriate application/proceedings before the court of competent jurisdiction. The instant application is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
