By the present writ petition, the petitioner who is running a small shop in the market known as ‘Sasta Market’ situated at G.E. 2 / 3 Road, Bhilai, District Durg, is seeking a direction towards the respondent authorities to execute the sale deed in favour of the petitioner. Though the lease granted to the petitioner was upto the period of 31/03/2023 but in spite of the request made by the petitioner before the respondent/ Municipal Corporation, Bhilai for allotment of shop in question to the petitioner, no steps has been taken by the Corporation till date. 2. Learned counsel appearing for the petitioner submits that the writ petition be disposed of with a direction to the Corporation to consider the case of the petitioner afresh in accordance with law. 3. Learned counsel appearing for the Municipal Corporation submits that if the petitioner will submit a representation to the Corporation, the Corporation shall consider the same in accordance with law within the stipulated period. 4. I have heard learned counsel for the parties and perused the documents. 5. In view of the submission made by the learned counsel for the petitioner that the petitioner is having possession over the small shop in question and the period of lease has been expired in the year 2023 and the petitioner has submitted representation for allotment of the shop to the petitioner, the petitioner is directed to file a fresh representation before the Commissioner, Municipal Corporation, Bhilai. In the event of filing of such representation, the respondent No.3/ Municipal Corporation, Bhilai is directed to consider the same and take a decision on the representation of 3 / 3 the petitioner in accordance with law, within a period of three months from the date of filing of the representation. 6. The petitioner is at liberty to apprise the respondent authorities with regard to the order passed by this Court. 7. With the aforesaid direction, this writ petition is disposed of.
