Hon'ble Dr. Yogendra Kumar Srivastava,J. 1. Sri Udit Chandra has appeared for the Electricity Department and states that Recovery Certificate dated 03.06.2023, has been withdrawn on 24.05.2024. He submits that the recovery citation appears to have wrongly been sent to the petitioner, by the Tehsildar. 2. In view of the statement which has been made by the counsel for the Electricity Department, no further orders are required to be passed. The petitioner, in pursuance of the notice which was earlier sent to the petitioner on 13.04.2022, may pursue the matter further. 3. Learned counsel for the petitioner states that he had already filed a reply to the notice dated 13.04.2022 on 23.05.2022. 4. In this view of the matter, we direct that the representation/reply of the petitioner to the notice sent, be decided within a period of one month from today, by the respondent No. 3. 5. With these observations, the writ petition stands disposed of. 6. In view of the statement made by Sri Udit Chandra, learned counsel for the respondent-Electricity Department with regard to the recovery certificate being withdrawn, we quash the recovery citation.
