It has been stated by the Standing Counsel that a compliance affidavit showing compliance of the order passed by this court was filed in the office of the Court on 17.01.2025. The said affidavit is not on record. However, the Standing Counsel has handed over a copy of the said affidavit which is taken on record and has been perused by the Court. The office shall also restore the original copy of the compliance affidavit before consigning the file to records. The present application has been filed pleading willful disobedience of the order dated 31.01.2023 by this Court in Writ - C No. 1870 of 2023 whereby the Executive Engineer, Saryu Nahar Khand-5, Headquarter, Gonda, District Gonda was directed to consider and decide the representation of the applicants regarding appropriation of his land by a registered sale deed and non- payment of the consideration amount. The affidavit filed by the Standing Counsel discloses that the representation of the applicants was decided by order dated 16.01.2025 and the balance amount of the consideration value has been paid to the applicants. The order dated 16.01.2025 has also been annexed with the compliance affidavit. As the order passed by the Writ Court has been complied by the opposite party, no further orders are required to be passed in the present contempt application. The application is disposed of and consigned to records. Notice issued to the opposite party is discharged. The applicants have the remedy to challenge the order dated 16.01.2024 on merits before appropriate forum.
