At the very outset, learned counsel for the respondents raises a preliminary objection with regard to maintainability of the petition on the ground that the petitioner has assailed only a show cause notice issued by the Commercial Court dated 16.08.2024, by which the petitioners have been called upon only to submit the reply to the show cause notice as to why the proceedings may not be initiated against them. He further submits that in stead of submitting reply to the show cause notice, the petitioners have approached this Court. Confronted with the said fact, learned counsel for the petitioners submits that he will reply to the impugned show cause notice within 10 days from today. In view of the above, the petition is, accordingly, disposed of. However, in case the reply is submitted, the same may be decided on its own merit.
