L V S NAGARAJU The Court made the following: 2 ORDER: This Contempt Case is filed under Sections 10 to 12 of the Contempt of Courts Act, 1971 for willful, wanton and deliberate disobedience in implementation of the orders passed by this Court in W.P.No.1296 of 2024 on 12.01.2024. 2. The petitioner has filed the aforesaid writ petition aggrieved by the action of the respondents in failure to grant permission to fill the vacant teacher posts in the petitioner’s schools in accordance with Article 21-A of Constitution, including the violation of the provisions of the Education Act and also in contravention of Right of Children to Free and compulsory Education Act, 2009 and the rules made there under, wherein this Court passed the following order: “Considering the submission and on perusal of the material on record, this Court prima facie is of the opinion that there shall be interim direction to the respondents to act upon the representation dated 09.11.2023 submitted by the petitioner requesting to fill up the vacant aided posts, in accordance with the provisions of the Right of Children to free and compulsory Education Act, the Education Act and the rules made there under.” 3. Today, when the matter came up for hearing, Sri A. Surya Teja, learned counsel representing the Respondent No.3 has furnished copy of the proceedings dated 14.07.2025 issued by the District Educational Officer, Vizianagaram, as per which, Staff Selection Committee has been constituted for the purpose of filling up of Two Aided Secondary Grade Teacher Posts in 3 the Petitioner-Institution and the same is under process. Thereafter, a Departmental Nominee along with Committee members was also appointed and requested to conduct test duly following the procedure under Rule 12(4) in G.O.Ms.No.1, Edn., (PS.2) Department Dated 01.01.1994. 4. The said fact was also admitted by the learned counsel for the petitioner and submitted that the said procedure has already been completed and teachers have also been appointed in the petitioner institution after completion of the said selection process, as such, requested this Court to close the contempt case. 5. Accordingly, this Contempt Case is closed. There shall be no order as to costs.
