(Oral) Applicant is in judicial custody in Sessions Trial No.105 of 2024, arising out of FIR No.118 of 2024, under Sections 376, 323, 504 and 506 IPC, Police Station Premnagar, District Dehradun. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. This is the second bail application. The first bail application, being BA11 No.1441 of 2024, was rejected on 20.11.2024. 4. It is argued by learned counsel for the applicant that after rejection of the first bail application, the victim was examined in the court as PW-1 on 21.11.2024. Thereafter, her examination-in-chief continued on 2 02.01.2025. On that date, she did not support the case with regard to the incident dated 05.10.2023. 5. These facts are not denied by learned State Counsel. 6. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 8. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
