2 Baloda, District Baloda is seeking a direction towards the respondents’ authority for payment of compensation towards the petitioner’s land which has been used for construction of the Baloda Bypass Road during the year 2016-17 without making payment of any compensation to the petitioner.

Learned counsel for the petitioner submits that the respondents have constructed the Baloda Bypass Road over the land of the petitioner without acquisition of the land and even without making any payments towards compensation. He would further submit that the petitioner has submitted several representations, however, the same has not been decided till date and no compensation has been paid. Therefore, the respondents may be directed to take appropriate steps for acquisition of the lands of the petitioners in accordance with law.

Learned counsel for the State would submit that respondent No.4/SDO (Revenue) shall examine the claim of the petitioner by making a spot inspection and if it is found that the land of the petitioner has been used for construction of the said bypass, then necessary steps shall be taken for payment of compensation in accordance with law.
4. I have heard learned counsel for the parties, pleadings and the representations submitted by the petitioner.
5. From perusal of the pleadings made in the writ petition, it appears that the petitioner has made several representations to various Authority, but the same has not been taken into consideration.
6. Hence, the Sub-Divisional Officer (Revenue) is directed to conduct a spot inspection and demarcate the land of the petitioner within a period
3 of 30 days from today and if it is found that the land of the petitioner have been utilized for construction of said bypass, the competent authority shall proceed further for acquisition of land of the petitioner and shall make payment of compensation in accordance with law. The Collector, Janjgir-Champa, shall ensure payment of proper compensation to the petitioner, in accordance with law.
7. With the aforesaid direction, the writ petition is disposed of.
