The Stamp Reporting Section has submitted a report that the instant transfer application is not maintainable in view of the order passed by the Lucknow Bench on Transfer Application No. 121 of 2021. 3. The aforesaid case is reported as Babu Singh and others vs. Raj Bahadur Singh and others; 2022 (12) ADJ 178 (DB(LB). 4. The Division Bench in the aforesaid judgement has held that once an application is rejected by the District Judge, second application under Section 24 CPC is not maintainable before the High Court and a revision under Section 115 CPC would lie. 5. Learned counsel for the applicant seeks withdrawal of the instant application with liberty to avail remedy in terms of Babu Singh (supra). 6. Prayer made is allowed. 7. The instant application is dismissed as withdrawn with liberty to avail remedies as per Babu Singh (supra).
