The petitioner has preferred this application for grant of regular bail in connection with Didarganj P.S. Case No. 131/2025 dated 19.04.2025 registered for the offences punishable u/s 316(2), 318(4), 318(3), 336(3) and 303(2) read with Section 3(5) of the B.N.S.
3. As per the prosecution case, the informant is in the business of transportation and the name of his transportation is Adarsh Raj Road Lines. It is alleged that on 11.04.2025, the informant, on the guarantee of the co- accused Dilshad, who also owns a transport company by the name of ATC Transports, Shamli, U.P., got the goods loaded from Gowardhan Ispat Pvt. Ltd. on a truck bearing Registration No. HR-45-B-4845 for delivery at Jaiswal Steel,

Owner and driver of the truck is co-accused Arshad and he was accompanied by another driver, Eklas (petitioner). However, on 14.04.2025, the informant came to know that goods have yet not been unloaded. Thereafter, the informant tried contacting the F.I.R. named accused persons but they kept on making excuses. The informant suspects that all the F.I.R. named accused persons, in a planned conspiracy, have embezzled the goods. 4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged occurrence. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 01.05.2025. 5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. 6.
Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna in connection with Didarganj P.S. Case No. 131/2025, with the condition:-

The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner is liable to be cancelled. 7.
