At the very outset, learned counsel for the informant submits that in the instant case, the trial is going on, being Sessions Trial No. 66 of 2023 (Vijay and others Vs. State of U.P.) arising out of Complaint Case No. 18 of 2023, which proceedings have been challenged by the applicants by way of filing Criminal Misc. Application U/s 528 of B.N.S.S. No. 11393 of 2025 in which, the co-ordinate Bench of this Court has directed not to take any coercive action against the applicants, copy of order dated 08.04.2025 has been produced before this Court and is taken on record. Learned counsel thus argued that the present application has become infructuous and prays to dismiss the same as having become infructuous. Learned counsel for the applicants could not dispute the aforesaid submissions made by learned counsel for the informant and prays that he may be permitted to withdraw the present application as not pressed.
