Petitioner was a member of Palika Centralised Service who retired from the post of Deputy Director in Urban Development Department. He has challenged an order dated 09.04.2019, passed by Secretary, Urban Development whereby his representation staking claim for pay parity with Mr. Harsh Vardhan Mishra was rejected. 3. Learned State Counsel submits that since petitioner is a public servant within the meaning of U.P. Public Service Tribunal Act, 1976, therefore he has remedy of approaching the Tribunal and writ petition, therefore, would not be maintainable on the ground of availability of alternative remedy. 4. Learned counsel for the petitioner do not dispute the said submission. 5. Accordingly, we dismiss the writ petition on the ground of alternative remedy with liberty to petitioner to approach the Tribunal.
