Order No. 02
Dated 25th April, 2025
Heard the learned counsel appearing for the respective parties.
The petitioner is an accused in connection with S.T. Case No. 47 of 2021 arising out of Mango (Olidih) P.S. Case No. 247 of 2020, pending in the Court of learned Additional Sessions Judge-I, Jamshedpur.
The prayer for bail of the petitioner was earlier rejected in B.A. No. 9978 of 2021.
It has been submitted by the learned counsel for the petitioner that the petitioner is custody since 2.10.2020. It has further been submitted that the trial has not been completed. Learned counsel submits that Rajesh Singh was said to be the person who had shot at the deceased, but he has been granted bail by this Court in B.A. No. 4308 of 2021.
Learned A.P.P. has opposed the prayer for bail of the petitioner.
It appears from the postmortem report that no firearm injury was found on the person of the deceased and in fact the deceased was crushed by the wheel of the vehicle which was being driven by the petitioner.
Regard being had to the fact that the case of the petitioner stands on a different footing to that of the co-accused Rajesh Singh, I am not inclined to reconsider the prayer for bail of the petitioner, which stands rejected once again.
