Jyotsna Rewal Dua, Judge Petitioner seeks enforcement of decision rendered in Sunita Devi vs. State of H.P. & Ors.1. The operative directions issued in the said decision are as under:-
“5. For this reason, the present writ petition is allowed to the limited extent that the impugned order dated 26.10.2024 (Annexure P-6) is quashed and set aside. Respondent No.4 is directed to consider and decide the case of the petitioner in light of the law laid down in Surajmani’s2 case within a period of four weeks from today. The order so passed be also communicated to the petitioner. The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.”
Respondents have filed the compliance affidavit. Along with compliance affidavit, consideration order passed

on 31.05.2025 has also been appended. As per this order, upon consideration of the case of the petitioner, work-charge status was conferred upon him retrospectively from the dates indicated therein on notional basis in view of decision rendered in Surajmani2.

The surviving grievance of the petitioner is in relation to refixation of petitioner’s pay accordingly. Learned Deputy Advocate General submits that based upon the
consideration order dated 31.05.2025, the respondents have expedited the process for refixing the petitioner’s pay.

In view of above, this execution petition is
disposed with directions to the respondents to issue appropriate and necessary order(s) refixing the pay of the petitioner consequent upon the consideration order dated 31.05.2025 within a period of three weeks. Petitioner, however, is at liberty to seek appropriate remedy in accordance with law for redressal of his surviving grievances, if any.
Pending miscellaneous application(s), if any, to also stand disposed of.
