2. The petitioner seeks bail in connection with Bettiah Town P.S. FIR No. 87 of 2022, in a case registered for the offence punishable under Sections 408, 420, 468, 323, 504, 120B of the IPC.
3. As per the prosecution case, the petitioner along with co-accused person, namely, Sangeeta Gupta (wife of the petitioner), in a deliberate conspiracy, committed fraud and betrayal and defalcated Rs. 28,00,000/-.

4. It has been submitted on behalf of the petitioner that the petitioner is innocent and has falsely been implicated in the present case. The petitioner is in incarceration since
15.06.2022.
5. Learned APP for the State and learned counsel for O.P. No. 2 have opposed the prayer for bail by submitting that conduct of the petitioner is not fair. The petitioner handed over a cheque of Rs. 13,00,000/- in the Court to the informant on 10.10.2025 but it was dishonoured by the bank. It has further been submitted that the petitioner is also involved in three cases of similar nature.
6. Considering the aforesaid facts and circumstances, in my view, the petitioner does not deserve privilege of bail. Accordingly, the present bail application is rejected.
7. The provisional bail granted to the petitioner vide
order dated 20.04.2023 is hereby recalled and the learned Court below is directed to take all necessary steps to apprehend the petitioner.
