Heard the parties.
The petitioner has been made accused in connection with Deoghar (Cyber) P.S. Case No.12 of 2025 registered for the offences punishable under Section 319(2), 318(4), 338, 336(3), 340(2) and 61 of the B.N.S., 2023 and Section 66(B), 66(C), 66(D) 84(C) of the Information Technology Act.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in cybercrime and he had defrauded the victim Jhunna Kumar to the tune of Rs.2,010/-. It is submitted that the allegation against the petitioner is false. Drawing attention of this Court towards para-16 of the instant bail application, learned counsel for the petitioner submits that the petitioner has no criminal antecedent. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case and that he will transfer the amount allegedly defrauded from the aforesaid victim Jhunna Kumar having Mobile No.9599619175. It is also submitted that the co-accused, with similar allegation, has already been admitted to bail by this Court vide order dated 28.04.2025 passed in B.A. No.3269 of 2025. It is lastly submitted that the petitioner has been in custody since 27.01.2025 as is evident from para-17 of the instant bail application. Hence it is submitted that the petitioner be released on bail.
Learned Addl. P.P. opposes the prayer for bail.
Considering the facts of this case, the above-named petitioner is
directed to be enlarged on bail on showing proof of transferring Rs.2,010/- in the account of the victim Jhunna Kumar having Mobile No.9599619175 and on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Cyber Crime Case, Deoghar in connection with Deoghar (Cyber) P.S. Case No.12 of 2025 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case.
