This is the second bail application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023, filed by the applicant who is arrested in connection with Crime No. 377 of 2024, registered at Police Station New Rajendra Nagar, Raipur, District Raipur, Chhattisgarh, for the offence under Section 7 of the Chhattisgarh Gambling (Prohibition) Act, 2022. 2. The first bail application of the applicant is dismissed by this court on merits vide order dated 29-11-2024 passed in M.Cr.C. No. 7906/2024.

Learned counsel for the applicant would submit that the applicant is arrested for the offence of Section 7 of the Chhattisgarh Gambling (Prohibition) Act, 2022 and the minimum sentence is provided for the offence is One year and the applicant is in jail since 28-09-2024 and thereby he already remained in jail for more than 05 months. Only 02 witnesses have been examined till date, and the other witnesses are not turning up for their evidence therefore, the final adjudication of the case will take its own time. Therefore, the applicant has filed this second bail application.

On the other hand, learned state counsel opposed and submitted that the allegation against the applicant is that he actively involved in playing online gambling and from his mobile phone, the connection with Ratan Online Book App and other links were found. In the trial, charge has been framed on 28-11-2024 and out of total 04 witnesses, 02 witnesses have already been examined on 04-01-2025 and only the investigation officers are remained for their examination. The first bail application of the applicant is dismissed on merits and therefore, his second bail application is liable to be dismissed.
5. I have heard the learned counsel for the parties and perused the case diary.
6. Considering the submissions made by the parties, the nature of the allegation and material collected during the investigation, and further
3 considering that the first bail application of the applicant is dismissed on merits on 29-11-2024, out of total 04 witnesses, 02 witnesses have already been examined, and only the investigating officers are to examine, I do not found any ground to change in circumstance and to release the applicant on bail.
7. Accordingly, his second bail application is rejected.
8. A copy of this order be forwarded to state counsel, who shall inform the concerned Superintendent of Police for the production of their witnesses before the learned trial court on the date fixed for recording of their evidence. Sd/- (Ravindra Kumar Agrawal) Judge ved
