The instant writ petition has been filed for the following reliefs:- "(i) Issue appropriate a writ, order or direction in the nature of mandamus commanding and directing the respondent nos. 2 and 4 to remove the illegal encroachment/ construction over the land arazi No. 207, measuring area 0.0610 hectare which is recorded in the revenue record as Khalihan, situated at Village Chhadaini, Pargana- Ekdala, Tehsil Khaga District Fatehpur in the interest of public at large. (ii) Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to decide the case No. T202302250305374 (Gaon Sabha Vs. Babulal and another) which is still pending since December 2022, before Tehsildar Tehsil Khaga, District Fatehpur." 3. Counsel for the petitioner submitted that proceeding under Section 67 of U.P. Revenue Code, 2006 is pending before respondent no.4, Tehsildar, Tehsil- Khaga District Fatehpur since 2023. He further submitted that appropriate direction be issued to respondent no.4 to decide the aforementioned proceeding under Section 67 of U.P. Revenue Code, 2006 within time bound period. 4. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to respondent no.4, Tehsildar, Tehsil- Khaga District Fatehpur to consider and decide the aforementioned proceeding in accordance with law expeditiously.
