2025:HHC:3537 IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA CWP No. 3800 of 2024 Date of Decision: 25.02.2025 Anita Gupta and others ...Petitioners. Versus H.P. Housing and Urban Development Authority ...Respondent. Coram Hon’ble Mr Justice Tarlok Singh Chauhan, Judge. Hon’ble Mr Justice Rakesh Kainthla, Judge. Whether approved for reporting?1 For the Petitioners : Mr. Devender K. Sharma, Advocate. For the Respondent : Mr. Kush Sharma, Advocate. Tarlok Singh Chauhan, Judge (Oral): Learned counsel for the petitioners vehemently argued that the scheme floated by the respondent along with the regulations is unconstitutional. However, learned counsel for the respondent states that since the scheme itself has been withdrawn, the challenge to the said scheme is only academic. 2. We are in agreement with the submission of learned counsel for the respondent. Now that the scheme has been withdrawn by the Government of Himachal Pradesh, therefore, the instant petition assailing various clauses of the scheme and regulations has been rendered infructuous and is disposed of accordingly. 1 Whether reporters of Local Papers may be allowed to see the judgment? Yes. 2 2025:HHC:3537 3. In case, such kind of scheme is floated in future by the respondent and the petitioners/anyone of them are aggrieved by the same, then the dismissal of the petition shall not come in their way while assailing the same. 4. Pending application(s), if any, stand(s) disposed of. (Tarlok Singh Chauhan) Judge (Rakesh Kainthla) Judge 25th February, 2025 (Nikita/Chander)
