By means of this writ petition, petitioner has sought a direction to the Principal, MBRG College, Haldwani to permit him to participate in the election, even though he has crossed the upper age limit. 3. Learned counsel for petitioner contended that since no election to Students’ union were held in 2024, therefore, petitioner could not contest the election last year and now this year he has become over age. 4. Learned State Counsel, however, points out that petitioner was not a student in the concerned college during last academic session and he has taken admission only in 2025, therefore, the contention that due to non holding of election he could not contest is misleading. 5. This Court finds substance in the submission made by learned State Counsel. Even otherwise also, Hon’ble Supreme Court, in the case of University of Kerala (1) Vs. 2025:UHC:8114 Council, Principals’, Colleges, Kerala and others, reported in (2006) 8 SCC 304 has approved the report submitted by Lyngdoh Committee and in that judgment the upper age limit for participating in the election has been indicated. 6. Thus, this Court do not find any reason to interfere in the matter. The writ petition fails and is dismissed.
