Heard learned counsel for the applicant as well as learned Additional Government Advocate for the State of U.P. and perused the record. The present bail application has been filed by the applicant seeking bail in Case Crime No. 13 of 2024 (Case No. 1253 of 2017) , under Sections 147,148,336,436,427,504,506,323,332,353 IPC, 7 Criminal Law Amendment Act and 3/4 Prevention of Damages to the Public Property Act, Police Station- Sirsaganj , District - Firozabad . Learned counsel for the applicant submitted that the applicant is innocent and has been falsely implicated in the present crime. It is submitted that the applicant was not named in the FIR; there was no independent public witness to prove the alleged incident as well as recovery; no incriminating article has been recovered either from the possession of the applicant or on his pointing out; no specific role has been assigned to the applicant; general allegations has been made against all the accused. It is stated that after taking note of entire facts and circumstances of the case, co-accused, namely, Murari @ Krishna Murari , has already been enlarged on bail by this Court vide order dated 2.2.2024 passed in Criminal Misc. Bail Application No. 45219 of 2023 . Accordingly, the applicant is also entitled for bail. Learned A.G.A. has, however, opposed the prayer for grant of bail, but he has not disputed the above contention made by the learned counsel for the accused- applicant that co-accused has already been released on bail. Considering the facts and circumstances of the case, perusing the record and also considering the nature of allegations, arguments advanced by the learned counsel for the parties and keeping in mind that co-accused has already been released on bail by this Court and without expressing any opinion on the merit of the case, I find it to be a fit case for granting bail.
