IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) [3332] THURSDAY ,THE THIRTIETH DAY OF JANUARY TWO THOUSAND AND TWENTY FIVE PRESENT THE HONOURABLE SRI JUSTICE RAVI CHEEMALAPATI WRIT PETITION NO: 7350/2021 Between: Podduturi Naga Lakshmi, and Others ...PETITIONER(S) AND The State Of Andhra Pradesh and Others ...RESPONDENT(S) Counsel for the Petitioner(S):
1. SURAGANI KRISHNA VAMSI Counsel for the Respondent(S):
1. GP FOR REVENUE The Court made the following order:
Non-consideration of the petitioners’ representation dated 08.03.2020 for allotment of house sites to them by conducting enquiry in Lingala Village, Vatsavai Mandal, Krishna District, is the grievance of the petitioners. 2. Heard Sri Suragani Krishna Vamsi, learned counsel for the petitioners and Sri J.Krishna Praneeth, learned Assistant government Pleader for Revenue. 3. Learned counsel for the petitioners in elaboration to what has been stated in the affidavit contended that, the petitioners have made a representation dated 08.03.2020 to the respondent authorities for allotment of house sites to them after conducting enquiry, but so far no orders have been
passed on the said representation. As such filed the present writ petition and sought for a direction to consider and pass orders on the petitioners’ representation. 4. On the other hand, learned Assistant Government Pleader for Revenue submitted that, on the representation made by the petitioners, the authorities have conducted enquiry and a report was also prepared and needs to pass orders on the same and sought time in that regard. 5. A perusal of the record would indicate that, the petitioners have made a representation dated 08.03.2020 to the respondents for allotment of house sites to them after conducting enquiry but the same was not yet considered nor passed orders on the same. As per the contentions of learned Assistant Government Pleader, the authorities have intention to pass orders on the petitioners’ representation and report was also prepared after conducting enquiry. In view of the same, as the authorities have intention to pass orders on the petitioners’ representation, there is no purpose in keeping the writ petition pending.
As such this Court is inclined to dispose of the writ petition with the following direction:
The respondent authorities are directed to consider and pass a reasoned order on the petitioners representation dated 08.03.2020 and communicate the same to the petitioners, as expeditiously as possible not later than eight (08) weeks from the date of receipt of copy of this order. Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous applications, pending if any, shall stand closed. ________________________ JUSTICE RAVI CHEEMALAPATI BRS
