This appeal challenges the judgment of conviction dated 23.10.2024 and order of sentence dated 24.10.2024 passed by Additional Sessions Judge, (POCSO Act), Bijnor in Sessions Trial No. 266 of 2018, thereby convicting the appellant under Sections 304, 201 I.P.C., followed by imposition of sentence of ten years, under Section 304 I.P.C. with fine of Rs.20,000/- and three years under Section 201 I.P.C. with fine of Rs.10,000/, with a further condition that in the event of non deposit of fine(s), convict shall undergo further imprisonment of six months and two month, respectively. The applicant-convict was prosecuted through Case Crime No. 68 of 2018, under Sections 304, 201 I.P.C., registered at Police Station Kotwali Shahar, District Bijnor. Learned counsel for the appellant has stated that during the pendency of the appeal, convict-Mahendra has died. Thus, the appeal abates qua the appellant.
