And 8 Others Counsel for Petitioner :- Arun Kumar Patel Counsel for Respondent :- C.S.C.,Pradeep Singh Hon'ble Syed Qamar Hasan Rizvi,J. 1. Heard Sri Arun Kumar Patel, learned counsel for the petitioner; Sri Nand Lal Maurya, learned Standing Counsel for the State- respondents and Sri Pradeep Singh, learned counsel for the Land Management Committee-respondent no.4. 2. This Court vide order dated 10.07.2025 directed the learned Standing Counsel to seek instructions in the matter. 3. Learned Standing Counsel appearing on behalf of the State- respondents placed before the Court the instructions dated 31.07.2025 received from the Sub Divisional Magistrate, Tehsil Chunar, District- Mirzapur. The same are taken on record. 4. On the basis of the aforesaid instructions, learned Standing Counsel made statement that the impugned order dated 10.10.2022 passed by the Commissioner, Vindyanchal Mandal, Mirzapur (respondent no.2) in the Case No.931/2022, under Section 210 of the U.P. Revenue Code, 2006 was challenged by one Pramod Kumar who was one of the revisionists along with the present petitioner in the said revision by means of a writ petition having Writ- C No. 40278 of 2022 and the said writ petition was dismissed by this Court vide order dated 19.12.2023. 5. The relevant part of the order dated 19.12.2023 is extracted hereinbelow: "6. Being aggrieved with the order dated 13.01.2022, petitioner filed a restoration application but respondent no. 3 dismissed it vide order dated 29.03.2022. Against the order dated 29.03.2022, petitioner moved a revision before the respondent no. 2 which was registered as case no. 931 of 2022 and the same was also dismissed vide order dated 10.10.2022. 7. Learned counsel for petitioner challenged the impugned orders on several other grounds inter alia that impugned order has been passed by respondent authorities without considering the fact and circumstances of the case and in an arbitrary manner. 8. Learned counsels for the respondents vehemently opposed the prayer sought through the instant petition and submitted that the impugned orders are fully justified. 9. After hearing the rival submissions extended by learned counsel for the parties and perusing the records, it is crystal clear that the impugned orders have been passed after duly considering the pleadings and evidences which were put forward during the proceedings and as such this Court is of the opinion that no good ground exists for any kind of interference in the impugned orders. 10. In view of the aforesaid facts and circumstances, the instant petition stands dismissed accordingly." 6. The fact of the dismissal of the aforesaid Writ- C No. 40278 of 2022 has not been disputed by the learned counsel for the petitioner and further the said dismissal order dated 19.12.2023 has not been challenged before any court of law. As such, the same has attained finality. 7. Taking into consideration the fact that the writ petition challenging the order dated 10.10.2022 has already been dismissed, nothing survives in the present writ petition to adjudicate upon. 8. Accordingly, the present writ petition is dismissed in terms of the order dated 19.12.2023 passed in Writ- C No.40278 of 2022.
