Neutral Citation No. - 2025:AHC:61764 Court No. - 85 Case :- WRIT - C No. - 41984 of 2024 Petitioner :- M/s Chaudhari Tikayram Ram Lal Gulati Respondent :- State of U.P. and 3 others Counsel for Petitioner :- Prateek Sinha Counsel for Respondent :- C.S.C.,Gaurav Gulati,Manaal Afroz Hon'ble Kshitij Shailendra,J.
1. Heard learned counsel for the parties.
2. This writ petition has been filed seeking expeditious disposal of Mutation Case No.5268 of 2020 (Ajay Gulati vs. Firm Chaudhary Tikayaram Ram Lal Gulati).
3. Ms. Manaal Afroz, learned Advocate has appeared on behalf of respondent No.4 and seeks time to file a counter affidavit.
4. A perusal of order sheet indicates that on 07.03.2025 also, time was granted to file reply.
5. The Court expresses its surprise as to how a prayer for expeditious disposal of mutation proceedings can be opposed by the respondent No.4 and it appears from the order dated 04.10.2024 passed by the Tehsildar that even before his Court also, the respondent No.4 sought time to file objections.
6. The mutation matter being summary in nature and being pending since 2020, this Court is not inclined to grant any further time to respondent No.4 to file counter affidavit nor counter affidavit is required in such a matter where this Court is not concerned with the merits of the mutation matter.
7. The writ petition is disposed of directing the respondent No.3- Tehsildar, Tehsil Soroan, District Allahabad to decide the mutation proceedings on or before 31.07.2025, strictly in accordance with law, provided a copy of this order is filed in his Court within two weeks.
