Heard Sri Birendra Singh, learned counsel for petitioner and Sri Sant Ram Sharma, learned counsel for respondents 2 to 4. 2. Unfortunately, averments in present writ petition are not happily worded since order dated 21.10.2024 which is adverse to petitioner whereby his salary was stopped is not under challenge. Still the Court is of considered opinion that in a writ jurisdiction even without such challenge, if said order is illegal on face of it, it could be interfered. 3. The order dated 21.10.2024 is quoted below :- “ककरकरलर- जजलक पररषद कक षष महकषवदकलर, बकबदक (उ०प०) पतकबक : 10054/2024-25 षदनकबक : 21.10.2024 शश रकमषनवकज जसबह, सथकपनक जलषपक, जज०प०कक ० महक० बकबदक। आपकक दकरक पकषषत पत षदनकबक 16.10.2024 मम मक० अधरक/पबनधक महहदर कक पकररत आदकश कक पररपकलन मम ससषचत हह षक महकषवदकलर कक नहषटस पतकबक-10035/2024-25 षदनकबक 19.09.2024 कक कम मम आपकक दकरक षदनकबक 23.09.2024 कह पकषषत सपषशकरण कह मक० अधरक / पबनधक महहदर कक समक पतकवलश मम आखरक सषहत अषगम आदकश हकतत पसततत षकरक गरक जजस पर उक पकरण कक जकजच हकतत षशकक सषमषत कक तशन सदसरशर सषमषत (1- शश सबतरकम जसबह , 2- शश इनदजशत रकदव , 3- शश रकजकरकम षवशकमकर , सदसर ) सक करकरक जकनक एवब उनकक जकजच आखरक पकप हहनक तक आपकक वकतन भतगतकन रहकनक कक आदकश पकररत षकरक गरक हह। असतत आप उपरतरक गषठत जकजच सषमषत दकरक कक जक रहश जकजच मम सहरहग पदकन करम। ( डक० आर०कक ० गतपक) पकचकरर जजलक पररषद कक षष महकषवदकलर, ” बकबदक। 4. It is very surprising that during pendency of a departmental proceeding, without any other adverse order against the petitioner, his salary has been stopped. 5. Learned counsel for petitioner submits that petitioner is regularly working since 1993 and according to his instructions, no complaint has ever been made during such long service period and still he is not aware about any allegation against him. 6. Learned counsel for respondents - 2 to 4 has not able to show any provision under which said order can be passed i.e. for stoppage of salary without any adverse order. 7. Accordingly, order dated 21.10.2024 is set aside to the extent that salary of petitioner cannot be stopped without any order passed in due process and in accordance with law. 8. Principal, Zila Parishad Krishi Mahavidyalaya, Banda is put on caution that such illegality may not be repeated since petitioner has constrained to move this Court on such illegal order. 9. So far as pending inquiry is concerned, it can proceed in accordance with law. 10. Writ petition stands disposed of with above observations. Order Date :- 20.2.2025 Sinha_N.
