THE HON’BLE SRI JUSTICE HARINATH.N CRIMINAL PETITION No.2763 OF 2024 ORDER: 1. Heard the learned counsel for the petitioners. 2. The learned counsel for the petitioners submits that the petitioners were arraigned as A.2 to A.4 in C.C. No.97 of 2024 on the file of the Court of Additional Junior Civil Judge, Ponnur, registered for the alleged offences under Sections 498-A of the Indian Penal Code, 1860 and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 3. The learned counsel further submits that petitioner No.1 is the mother- in-law, petitioner No.2 is the father-in-law and petitioner No.3 is the brother-in-law of the 2nd respondent/ de facto complainant. The marriage of A.1/ son of petitioners 1 and 2 with the 2nd respondent/ de facto complainant was solemnized in the year 2015. On account of certain marital disputes, the 2nd respondent has filed a complaint before the police. After the investigation, the police filed the charge sheet before the learned Magistrate. 4. It is submitted that the petitioners have no role in the marital disputes of A.1 and the 2nd respondent. After the marriage, A.1 and the 2nd respondent were staying at Visakhapatnam and further submitted that the allegations are also vague, and no specific allegations are made against the petitioners. -2- CRL.P. No.2763 of 2025 5. Considering the submissions, the appearance of the petitioners/A.2 to A.4 in C.C. No.97 of 2024 on the file of the Court of Additional Junior Civil Judge, Ponnur, is dispensed with, subject to filing an undertaking to appear before the learned Magistrate as and when required and directed for the purpose of trial. 6. Accordingly, the criminal petition is disposed off. 7. Miscellaneous petitions, if any, pending in the criminal petition shall stand closed. ____________________ JUSTICE HARINATH. N Dt.17.03.2025. BV
