Forest (Amendment) Act, 2016. 2. Case of the prosecution, in brief, is that this is a case of criminal conspiracy, abetment to commit the offence, trespass into reserve forest without permission, cut the live red sander trees and committed theft and trying to shift by loading for the purpose of smuggling red sander logs that occurred on 04.02.2025 at 06.00 cz_3Z:Zff3f} 2 I. a.m., near Jorikona Reserve Forest, VeeraballI' Forest Beat, Sanipai Section and Range, in which accused Nos.1 to 6 were arrested and 09 red sander logs, weighing{ 281 Kgs and 06 cell phones were seized from their possession. 3. Heard. Perused the record. 4. Learned counsel for the petitl®oners submits that the petitiorlerS herein are COOlieS and they are no way connected with the offence alleged and they have been falsely implicated in the present crime. 5. On the other hand, learned Assistant Public Prosecutor submits that Al and A2 are l'nvolved in other crime and A3 to A6 have no previous criminal antecedents. 6. Considering the nature of offence and considering the fact that no previous antecedents have been reported against A3 to A6, this Court is inclined to consider the petition in respect of A3 to A6 with the following conditions. 7. The PetitionerNos.3 to 6/A3 toA6 shall be released on bail on their executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties of the like sum each to the satisfaction of the learned Judicial Magistrate of First Class-Gum-Spec,+al Court for Trial of Cases relating to +Red Sanders Smuggling, Tirupati. On release, petitioner Nos.3 to 6/A3 -+- I_- 3 J/ to A6 shall appear before the Station House Officer concerned, once in a-week i.e. on every sunday between 10.00 a.m. and 01.00 p.m., for a period of three (3) months and they shall co- operate with the investigation. 8. ln view of involvement of Al and A2 in other crime, the petition in respect of petitioner Nos.1 and 2/Al and A2 is dismissed. 9. Accordingly, the Criminal Petition is partly allowed.
