The petitioner has preferred the present petition inter alia with the prayer to direct the respondent no. 3 Tehsildar, Tehsil Karvi, District Chitrakoot to consider and pass appropriate order on the application of the petitioner dated 12.11.2024 for removal of encroachment over the public path as well as the water course and source of the water within a stipulated time. 2. It is argued that aforesaid applicant has been submitted by the petitioner as per provisions under section 26 of U.P. Revenue Code, 2006. 3. After going through the same it transpires that the application alleged to be submitted by the petitioner on 12.11.2024 before the respondent no. 3 was not as per the procedure prescribed under section 26 of the Code, 2006. 4. In this view of the matter and also in the interest of justice the present petition is disposed of finally permitting the petitioner to submit an application before the concerned competent authority as per section 26 of the Code, 2006, if such an application is filed before the concerned competent authority, he will pass appropriate orders strictly in accordance with law and without granting unnecessary adjournment unless there is no legal impediment.
