Jyotsna Rewal Dua, Judge This writ petition has been filed for grant of following substantive reliefs:- “i) That the impugned order Annexure P-7 dated 24.12.2024 may kindly be quashed and set aside in the interest of law and justice. (ii) That the respondents may kindly be directed to immediately and forthwith grant approval/permission for lifting dry and fallen Chir trees from the area of operation of the petitioner society as per auction held, qua which information is given to respondent No.4, 1 Whether reporters of Local Papers may be allowed to see the judgment? Yes - 2 - without any further delay.” 2. On consideration of the case, following order was passed in the matter on 09.01.2026:- “Learned Additional Advocate General has handed over a copy of instructions, dated 08.01.2026, in terms whereof, it is mentioned that the case of the petitioner is under consideration of the Authority concerned. As prayed for, list on 26.02.2026, however, it is ordered that in the present case the prayer of the petitioner be considered forthwith and appropriate decision be taken within two weeks from today and in case the Authority deems it property, appropriate permission be granted to the petitioner, as learned Senior Counsel for the petitioner submits that the season for making Charcoal shall be over soon.” 3. Pursuant to the above, learned Assistant Advocate General has placed on record office instructions dated 25.02.2026 from the Deputy Conservator of Forests, Una Forest Division Una, H.P., conveying that Government of Himachal Pradesh has allowed felling of dried Chil Trees due to natural calamities, deceased or insect attack etc. vide notification dated 25.02.2026. Copy of the said notification has also been appended alongwith the office instructions. Learned Assistant Advocate General, on the basis - 3 - of aforesaid instructions and appended notification, submits that the concerned Division Forest Officer will issue necessary permission in accordance with law in petitioner’s favour within two weeks i.e. latest by 15.03.2026. 4.
