2025:JHHC:12068 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No.2454 of 2025 ------ Md. Saiyya Alam @ Saiya Alam, son of MD Mustakim, resident of 6/10, Ketul Modi Basti Chhota Nagari, P.O. & P.S. Katras, District Dhanbad. ... ... Petitioner Versus The State of Jharkhand. ... ... Opposite Party ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Haider Ali, Advocate For the State : Mr. Prabir Kumar Chatterjee @ Prabir Chatterjee, A.P.P. ----- 02/ 22.04.2025 This Anticipatory Bail Application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) 2023, has been filed by the petitioner apprehending his arrest in connection with Giridih (Town) P.S. Case No.80 of 2020, for offences under Sections 143, 188, 269, 270, 414, 290, 291 and 109 IPC. The case is presently pending before the Court of learned Chief Judicial Magistrate, Giridih. 2. Heard the parties at length. 3. The occurrence is of the year 2020. The motorcycle of the petitioner was seized on the date of occurrence but he did not chose to appear before the police, nor surrendered before the Court. Only in the year 2025, the petitioner has approached this Court by filing anticipatory bail application. 4. Learned A.P.P. submits that the petitioner has not cooperated with investigation. 5. Considering the fact that the petitioner is approaching the Court after five years and he had knowledge about this case since his motorcycle was seized by the police, as the petitioner is not cooperating in investigation, this is not a fit case for grant of anticipatory bail. 6. Accordingly, this Anticipatory Bail Application is dismissed. (ANANDA SEN, J.) Prashant. Cp-3
