As per the instruction received by learned AGA, corpus himself is absconding accused in case crime no. 209 of 2023, wherein he has been implicated as one of the accused with the allegation of attempt to murder of his wife, who is still absconding and is not attending before any court of law. 2. The instant petition has been preferred by the father of the absconding accused which is subject matter of investigation pending in case crime no. 209 of 2023. Since the extension of legitimate right enforceable under Article 226 of Constitution of India cannot be extended in simpliciter manner in favour of a person who himself is an accused and implicated in FIR which has been registered at case crime no. 209 of 2023. 3. It is further submitted by learned AGA that total seven cases of criminal history created against the corpus and as such there is no ground to entertain the instant petition preferred at the behest of father of the corpus/petitioner no. 2. 4.
