Whether approved for reporting? For the Petitioner: Mr. Goldy Kumar, Advocate. For the respondents: Mr. Anup Rattan, Advocate General, Mr. Rajan Kahol, Mr. Vishal Panwar & Mr. B.C. Verma, Additional Advocate Generals, with Mr. Ravi Chauhan, Deputy Advocate General, for respondents-State. ___________________________________________________________________________ Sandeep Sharma, J. (Oral) Petitioner herein, who at present is working as TGT (Non- Med.), at Government Senior Secondary School Dadriyara, Tehsil Sihunta, District Chamba, Himachal Pradesh, has approached this Court in the instant proceedings, seeking therein direction to the respondents to consider and decide his pending representation (Annexure P-1), whereby he has prayed for his transfer from present place of posting to one of the stations, as detailed in the representation, on account of his having completed normal tenure of posting as well as couple case. 2. It has been averred in the petition, which is duly supported by an affidavit that the petitioner herein was initially appointed as TGT (Non-Med.) in 2019 and thereafter, he was posted at Government Senior Secondary School Dand, Tehsil Saloni, District Chamba, Himachal Pradesh. On 24.12.2024, petitioner was transferred to Government Senior Secondary School Dadriyara, Tehsil Sihunta, District Chamba, Himachal Pradesh and since then, he has been continuously working in the afore school. Since petitioner has already completed normal tenure of posting in the afore school, coupled with the fact that his wife, who is also working as TGT (Non- Medl.), is posted at Government High School Rounkher, Tehsil Nagrota Bagwan, District Kangra, Himachal Pradesh, he filed representation to the competent authority, seeking therein his transfer to one of the stations, as detailed in the representation, but since needful was not done, he is compelled to approach this Court in the instant proceedings. 3. Having regard to the nature of prayer and order proposed to be passed in the instant petition, this Court sees no necessity to call for the reply from the respondents, who are otherwise represented by Mr. Ravi Chauhan, learned Deputy Advocate General. Mr. Ravi Chauhan, learned Deputy Advocate General, fairly states that 2
representation (Annexure P-1) filed by the petitioner, if not already decided, shall be decided expeditiously. 4.
Consequently, in view of above, this Court, without going into the merits of the case, deems it fit to dispose of the present petition, with a direction to the respondents to consider and decide the pending representation (Annexure P-1) filed by the petitioner expeditiously, preferably within a period of four weeks from today. Ordered accordingly. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of being heard to the petitioner and pass appropriate orders thereafter taking note of provision contained in the Transfer Policy, which provides for transfer of an employee after his having completed normal tenure of posting at one place as well as on ground of coupled case. Pending applications, if any, stand disposed of. April 09, 2025 (Sandeep Sharma), (sunil)
