By means of the present criminal writ petition, petitioner has challenged the FIR No.504 of 2021 dated 10.11.2021, for the offences punishable under Sections 406, 420 IPC and under Sections 4 & 5 of the Prize Chits and Money Circulation Schemes (Banning) Act, 1978, registered with P.S. Kotwali Dehradun, District Dehradun. 4. It is informed by the learned State Counsel that after investigation, charge-sheet dated 25.08.2022 has been filed by the Police against petitioner, therefore, nothing remains to be decided in this writ petition. 5. Learned counsel appearing for the petitioner submits that he wants to challenge the said charge- sheet and for that purpose the present writ petition needs to be amended. 6. Having considered the submissions made by learned counsel for the parties, this Court is of the opinion that the interest of petitioner would be kept safe if it is left open to the petitioner to challenge the said charge-sheet in a separate proceeding in accordance with law. Accordingly, the present criminal writ petition is closed. However, it is open to petitioner to challenge the charge-sheet in appropriate proceedings, before the appropriate forum. 7. Pending application, if any, also stands disposed of.
