Present criminal appeal has been filed against the judgement and order dated 09.10.2007 passed by Additional Sessions Judge, Court No. 2, Bulandshahr convicting the appellant in Session Trial No. 1014 of 1994 (State vs. Ajay Kumar and others) and sentencing him 5 years rigorous imprisonment and a fine of Rs. 5000/- in default of payment of fine six month additional imprisonment under section 307 IPC and further convicting him under Section 302/34 IPC for life imprisonment and a fine of Rs. 10,000/- and in default of payment of fine six months rigorous imprisonment both sentences will run concurrently. 2. As per office report dated 22.3.2025 based on the report of Chief Judicial Magistrate, Bulandshahar dated 06.05.2024, according to which, the sole appellant Ajay Kumar died on 25.7.2008. The statement of Smt. Satyawati, wife of the appellant and the statement of Abhishek Kumar, son of the appellant regarding the death of the sole appellant is annexed. The death certificate has also been annexed. 3. Accordingly, present appeal stands abated. 4. However, the record of the present appeal shall remain connected with Criminal Appeal No. 71447 of 2007.
