Even, as seen from E-Court proceedings dated 30.09.2021, the Court noted that the 2 whereabouts of the petitioner are not known. As such, notice to sureties was also issued. 2. Considering the same, this Court is inclined to dispose of the quash petition directing the petitioner to appear before the learned Magistrate and also submit an undertaking, to appear as and when directed by the learned Magistrate. 3. The presence of the petitioner shall be dispensed with, subject to the petitioner submitting an undertaking as directed above. 4. Accordingly, the Criminal Petition is disposed of.
