The petitioner claims that his claim for promotion to the post of senior manager has not been decided. A representation in this regard has been made to the competent authority but to no avail. The only prayer made on behalf of the petitioner is that his representation may be decided within a stipulated period of time. Shri Yash Padia, learned counsel for the respondents submits that the matter requires factual determination as per applicable law by the competent authority in the first instance. However, he fairly contends that the service benefits/claims are liable to be decided by the competent authority in a reasonable time frame. In light of the submissions made at the Bar and without going into the merits of the case, the respondent no. 2 is directed to decide the representation of the petitioner for promotion to the post of senior manager as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation.
