JUSTICE RAJNESH OSWAL, JUDGE ORDER 18.11.2025 Learned counsel for the respondent, at the outset, has shared with us a copy of the Litigation Policy dated July 07, 2025 and particularly paragraph 2(b) thereof :- “2(b)Initial categorisation or the subsequent re-categorisation med bd assessed the disability(ies) as either attributable to or aggravated by mil service but RMB/IMB assessed the disability(ies) as NANA and accepted by the adjudicating authority.” Accordingly, he submits that per the Policy, cases that are covered by para 2(b), (c) & (d) are being processed for implementation, however, the cases covered by paragraph 2(a), since contrary to the entitlement, will continue to be contested and all legal remedies are to be exhausted. Thus, he asserts that the petition at hand filed by the Union of India would not survive any further. In response, Mr. Vishal Sharma, learned DSGI, as always, fairly submits that in the wake of the Policy, referred to above, he be permitted to withdraw the petition. Dismissed as withdrawn.
